Details:Following a thirteen-day trial in Barnstable County Superior Court in September of 2009, a jury awarded ARCADD, Inc. of Newton approximately $1.5 million in damages resulting from its wrongful termination as the architect of the Falmouth Public High School construction project. The jury also found that ARCADD did not breach the professional standard of care and was responsible for no damages to the Town on its $5 million counterclaim. ARCADD’s trial counsel, Ken Walton and Seth Pasakarnis of Donovan Hatem LLP lead an in-depth discussion of the trial, including lessons learned and the implications that the jury verdict may have on the public school construction process in Massachusetts, at the K-12 Educational Facilities meeting on May 20 at 9:30 am at Symmes Maini & McKee Associates, Inc (1000 Massachusetts Avenue, Cambridge). David Hatem, Esq. of Donovan Hatem also addresses the fairness of the justice system, public accountability for public owners, professional liability insurance concerns and the impact of recent proposed legislation concerning design professionals involved in public projects in Massachusetts.
